To avoid pitfalls before hiring ... know your obligations!

  Me Rhéaume Perreault, Fasken Martineau

Employers have a strong decision-making power in hiring future employees. However, this power must be used with caution and in particular in compliance with the Charter of human rights and freedoms. The well known duty of accommodation applies during the recruitment process.

Multiple verifications are sometimes carried out as part of the recruitment process: referrals, medical examinations, credit investigations, criminal records, screening tests, evaluation tests, etc.

Now add the social media aspect. Organizations are increasingly checking web content during the recruitment process. A census of jurisprudence shows that there is an increasing number of disputes over the recruitment process. Some companies have even been ordered to pay over $ 100,000 in damages as a result of an inadequate recruitment process that violates legislation. A rigorous recruitment process is without a doubt synonymous with major future savings.

All these elements will be discussed during the presentation.
